When a man or woman wrongs another in any way and so is unfaithful to the Lord , that person is guilty and must confess the sin he has committed. He must make full restitution for his wrong, add one fifth to it and give it all to the person he has wronged. (Numbers 5:6-7)
Here is “Reasonable” Prosecutor Satterberg
A basic, minimal compensation to those exonerated would go as follows:
All monies calculated on today’s money value.
Cost the State used to convict calculated, including inflation.
Cost the Defense team spent on legal defense to be paid to defense.
Average upper middle class income for the state of WA paid to those freed.
Detailed study of the Prosecution’s specific failures completed within one year.
Oversight committee made up of five non-legal individuals, unassociated with the justice system.
The report is to be hand delivered by the current head Prosecutor.
The total is then multiplied by two as a “penalty” paid as a lump sum for the individual to start over.
The lump sum should be calculated and paid within two months.
This would also apply to egregious prosecution for which the non-legal individuals would determine.
None should whine about budget shortfalls to pay for these restitutions. Stop treating prosecutions as if they were items at McDonald’s; so many served, and there will be a net savings for the State on every level.
[Rate of Inflation * (State’s Actual Cost + Defense’s Actual Cost) + Average Income *(Years during Defense + Years in Prison) + Oversight Committee + Hand Delivery of Report] * 2
And here’s the shorter form with a key:
RI – Rate of inflation from time of arrest
CC – The State’s actual cost to convict
LC – Actual legal defense costs
AI – Current average income of the upper middle class
TT – Years from time of arrest to sentencing, rounded up
PT – Years in prison, rounded up
OC – 5 Non-legal person oversight committee to study Prosecutor’s failures
HD – Cost of hand delivery of report to head Prosecutor
[RI * (CC + LC) + AI*(TT + PT) + OC + HD] * 2
One more thing…
When employers ask “Have you ever been arrested?” there must be an option where individuals can state, “Exonerated”.
